Terms of Service for Sleepy Notes

These terms explain the rules for using Sleepy Notes, including voice recording, generated audio, private family use, and account responsibilities.

1. Agreement to These Terms

These Terms of Service are a legal agreement between you and Little Keeps for your use of Sleepy Notes. By creating an account or using Sleepy Notes, you agree to these terms and to our Privacy Policy.

If you do not agree, do not use Sleepy Notes.

2. Parent or Guardian Use Only

Sleepy Notes is intended for use by adults who are parents or legal guardians. You must be at least 18 years old to create an account. You are responsible for any child profile you create and for ensuring that your use of the app is lawful.

3. Account Responsibilities

You are responsible for keeping your account secure and for all activity that occurs through your account. You agree to provide accurate information and to update it when needed. You must not share your account in a way that allows misuse of the app or another person's voice or content.

4. Voice Recording Rules

Sleepy Notes may allow you to record your own voice to personalise private audio for your family. You may record only your own voice unless you have explicit written consent from the speaker and the legal right to use that recording.

The voice feature is for adults recording themselves. You must not record a child's voice, and you must not use the feature to create a voice profile from a child's voice. This is not a rule you can consent your way around: a child cannot give the written consent described above, and we do not offer child voice profiles at all.

You must not use the voice feature to:

  • record a child's voice, or create a voice profile from one;
  • record, imitate, or impersonate a person without permission;
  • create celebrity, public figure, or third-party impersonations;
  • create deceptive, defamatory, illegal, abusive, or harmful content;
  • mislead others about who is speaking;
  • violate any law, contract, platform rule, or third-party right.

Misuse of the voice feature may result in removal of content, deletion of voice profiles, suspension, termination, and possible legal responsibility.

5. Generated Audio and Private Use

Generated audio in Sleepy Notes is for private, personal, non-commercial family listening inside the app. You must not sell, license, publicly post, broadcast, distribute, or commercially exploit generated audio unless Little Keeps gives you written permission.

You are responsible for making sure your use of generated audio is lawful in your location and does not infringe anyone else's rights.

6. Your Content

You may submit child profile details, custom notes, stories, messages, preferences, and voice recordings. You keep ownership of content you submit, but you grant Little Keeps the permission needed to host, process, generate, store, and play that content as part of Sleepy Notes.

You represent that you own or have the necessary rights and permissions for any content you submit. You must not submit copyrighted, private, illegal, harmful, or infringing content that you do not have the right to use.

7. Comfort and Entertainment Only

Sleepy Notes provides comforting audio, notes, stories, and related app experiences. It is not medical, therapeutic, educational, legal, parenting, safety, or emergency advice. Do not rely on Sleepy Notes for diagnosis, treatment, child safety, supervision, crisis support, or professional advice.

8. AI and Third-Party Providers

The narration in Sleepy Notes is generated by AI. Two things follow from that, and we would rather say them plainly than leave you to work them out:

  • Our preset narrators are AI voices. They have names and personalities so they are easy to tell apart, but they are not recordings of real people.
  • Stories narrated in your own voice are synthetic speech generated from the sample you recorded. They are made to sound like you, and they are not recordings of you reading those stories. You never read them.

Story text is not generated while your child listens. Every story ships with the app as fixed text, written and reviewed before release.

Sleepy Notes may use AI and third-party providers, including Cartesia for voice and text-to-speech processing, Supabase for app infrastructure, Google Cloud Run for backend processing, PostHog for analytics and diagnostics, Apple and RevenueCat for purchases and entitlements, Expo/EAS for app build and update infrastructure, and Cloudflare for hosting our legal and support pages.

You agree that these providers may process data as needed to provide Sleepy Notes, as described in our Privacy Policy.

Cartesia's own terms allow them to use content sent to their service, including voice recordings and generated audio, to train and improve their AI models, and grant them a broad licence over that content. We have switched model training off for our Cartesia organisation, which by Cartesia's description covers text-to-speech generations and speech-to-text transcriptions. Cartesia excludes voice cloning from that setting and from their no-retention option, and states that cloning requires retaining the uploaded audio sample or a voice model derived from it. An opt-out also does not apply to content sent before it took effect. If you are not comfortable with this, do not record your voice; preset voices involve no recording of you. See Section 7 of our Privacy Policy.

9. Purchases and Story Credits

Much of Sleepy Notes is free, and stays free. Without paying anything you can browse the whole story library, listen to any story narrated by one of our preset narrators, create a child profile, and record one voice profile of your own. Nothing in the library is locked behind a purchase.

What costs money is generating a story in your own recorded voice. That runs on a paid voice service, so it is paid for with story credits.

Sleepy Notes does not offer an auto-renewing subscription. Instead, premium access is sold through one-time in-app purchases:

  • Starter Pack — a one-time purchase that grants a bundle of story credits and permanently unlocks premium features (a second child profile, a second recorded voice, dual narration, personalised story text, pronunciation names, and writing your own stories). The premium unlock does not expire and does not need to be repurchased.
  • Recharge Pack — a one-time purchase of additional story credits only, available once you have purchased a Starter Pack.

Story credits are consumed when you generate a story, based on the length of the story text. Story credits do not expire and are not tied to a billing period. Current pricing, including any applicable taxes, is shown by Apple before you confirm a purchase.

All purchases are processed by Apple through its in-app purchase system, using RevenueCat to manage entitlements. We do not receive or store your full payment details.

Your story credits and your premium unlock are attached to your Sleepy Notes account, not to a particular device, so signing back in on a new device gives you both again. If anything looks missing after reinstalling or switching devices, use "Restore purchases" in Settings — that re-checks your purchase history with our payments provider and repairs your balance and unlock.

Because story credits are consumable digital items, credits you have already used cannot be refunded or reissued. Refund requests are handled directly by Apple under their own refund policies; contact us if you have a purchase issue and we'll help where we can. If Apple refunds a Starter Pack, the premium unlock it granted is removed.

10. Acceptable Use

You agree not to:

  • use Sleepy Notes for unlawful, harmful, abusive, or deceptive purposes;
  • attempt to bypass usage limits, consent flows, security controls, or purchase/ entitlement checks;
  • reverse engineer, scrape, overload, or disrupt the app or backend services;
  • upload malware or content that violates another person's rights;
  • use Sleepy Notes to create or distribute misleading voice or audio content.

11. Account Deletion and Termination

You may delete your account from the app settings. Little Keeps may suspend or terminate access if we reasonably believe that you have misused Sleepy Notes, violated these terms, created legal risk, attempted fraud, or harmed the service or other users.

To protect the service from abuse, requests to delete a voice or your account may be subject to a short cooldown, and account deletion requests are additionally subject to a daily limit. This does not affect your underlying right to delete your data, only how quickly repeated automated requests can be made.

12. Intellectual Property

Sleepy Notes, including its app design, templates, software, branding, and original content, is owned by Little Keeps or its licensors. These terms do not transfer any ownership rights to you except for the limited permission to use the app as allowed by these terms.

13. Disclaimers

Sleepy Notes is provided on an "as is" and "as available" basis. We do not promise that the app will always be available, error-free, uninterrupted, or that generated content will be accurate, suitable, or meet every expectation.

14. Limitation of Liability

To the maximum extent permitted by law, Little Keeps will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunity arising from your use of Sleepy Notes.

15. Changes to These Terms

We may update these terms from time to time. If changes are material, we will take reasonable steps to notify users, such as updating the app or this page. Continued use of Sleepy Notes after changes means you accept the updated terms.

16. Language

Sleepy Notes is available in English only. The app's screens, its stories, its narration and its support are all in English, and there are currently no other language versions. Please take that into account before purchasing.

These Terms, our Privacy Policy and our support pages are written in English. If any translation is provided, it is for convenience only, and the English version governs if the two differ.

17. Governing Law

These terms are intended to be governed by the laws of India, without regard to conflict of law rules, unless applicable consumer law requires another approach.
